  • Dutch law

These terms are governed by Dutch law, and you keep the consumer rights of the country you live in.

1. About these terms

These terms are the agreement between you and Neurova AI, Heideveldstraat 6, Eindhoven, the Netherlands (KvK 94328900), the company that makes FemNote ("we" and "us"). They apply when you use the FemNote app, the website femnote.com, the waitlist and the beta. For the iPhone app, they are also the licence agreement between you and us; The App Store and Apple explains what Apple requires.

By using FemNote you agree to these terms. If you don't agree, please don't use FemNote. How we handle your data is explained in our privacy policy.

2. Who can use FemNote

You must be 18 or older to use FemNote. FemNote is for your own personal use, not for business use.

The app needs an iPhone with iOS 17 or later. It is in English and Dutch, with German from May 2027.

3. Your account

You don't need an account. With a free account you can sign in with Apple, Google or an email code and keep your plan on a new phone. Your log is not part of your account: it stays on your phone, see Your data on your phone.

Keep access to your email address and your Apple or Google account secure, because they are how you sign in. Tell us if you think someone else has used your account.

4. Not a medical device

FemNote is a wellness app, not a medical device. It doesn't diagnose, treat, cure or prevent any condition. Patterns, signals and reports are based on what you log: a pattern shows what often comes before a symptom in your own log, not what causes it, and is not a diagnosis.

Cycle predictions are estimates and are not a method of contraception. FemNote doesn't show a fertile window, and you shouldn't use it to avoid or plan a pregnancy.

Always ask your doctor about symptoms that worry you, and before you make decisions about your health. If you are pregnant or breastfeeding, managing a medical condition, or have a history of disordered eating, talk to your doctor before you change what you eat. Before you cut out a food group in an experiment, talk to your doctor or a dietitian.

In an emergency, call your local emergency number, such as 112 in the EU, 999 in the UK or 911 in the US.

The PDF report is a summary of what you logged, to help you talk to your doctor. It is not a medical record or a medical opinion.

5. Recognition, product information and recipes

Photo recognition uses an AI model. It can make mistakes, so its results are suggestions: check them before you save. Label reading can also miss or misread ingredients.

Product information comes from Open Food Facts and Open Beauty Facts, open databases built by volunteers, and from the labels you photograph. It can be incomplete, wrong or out of date. Always check the label on the product itself, especially for allergens. Every flag in FemNote shows its source.

Brands can't pay for scores or flags. FemNote has no ads; if we ever show a sponsored product, it will be clearly labelled Ad.

Cook tonight ideas skip the foods on your watch list, but they can still contain allergens or ingredients that don't suit you. Always check ingredients and labels.

Product data in FemNote comes from the contributors of Open Food Facts and Open Beauty Facts. It is available under the Open Database License (ODbL), and their product photos under the Creative Commons Attribution-ShareAlike licence.

6. Your data on your phone

Your FemNote log lives only on your phone. We don't have a copy, so we can't restore it for you.

If Include in iPhone backup is off and you haven't exported your data, your FemNote data is lost when your phone is lost, stolen, broken, reset or replaced, or when you delete the app. To keep a copy, turn on Include in iPhone backup or export your data in the app, under You, then Privacy and data.

Exports and PDF reports are files you keep yourself. Look after them, because they contain your health data.

7. FemNote Premium and subscriptions

FemNote is free to use: scanning, daily check-ins, cycle tracking, a meal photo a day and your first signal. FemNote Premium adds every pattern with how sure we are, Cook tonight, experiments and the PDF report for your doctor.

Premium costs €34.99 a year or €4.49 a month (£29.99 or £3.99 in the UK, $29.99 or $3.99 in the US). Prices in euros and pounds include VAT. In other countries, and if prices change, the App Store shows the price in your currency before you buy, and that price applies.

You buy Premium with your Apple ID, and Apple charges it when you confirm the purchase or, with a free trial, when the trial ends.

Free trial: the yearly plan starts with 2 weeks free for new subscribers. You can use the free trial once per Apple ID, and not if you had FemNote Premium before. We remind you 3 days before the trial ends. The monthly plan has no free trial.

Your subscription renews automatically for the same period, unless you cancel at least 24 hours before the end of the free trial or the current period. Apple charges the renewal within the 24 hours before the period ends.

Cancel at any time in your iPhone settings: tap your name, then Subscriptions. Your plan stays active until the end of the period you paid for. Deleting the app or your FemNote account doesn't cancel your subscription.

Refunds are handled by Apple under its terms; you can ask for one at reportaproblem.apple.com. Any legal right to withdraw from the purchase, such as the 14-day right in the EU and the UK, is also handled by Apple under its terms. This doesn't limit your rights under the law.

If the price of your plan goes up, Apple tells you in advance and, where its rules or the law require it, asks you to agree. If you don't agree, your subscription ends at the end of the period you paid for. A new price never applies to a period you have already paid for.

8. Founding members and invites

Founding code: if you joined the waitlist, confirmed your email address and are still subscribed to our waitlist emails at launch, we email you a personal, one-time App Store offer code. It gives you your first year of FemNote Premium for €24.99, or the price the App Store shows in your currency. The code is valid for 14 days after we send it and works once. After the first year your plan renews at the normal yearly price, unless you cancel at least 24 hours before the year ends.

Codes are personal: one code per person. They have no cash value and can't be sold or exchanged. We may cancel codes that come from fake, automated or duplicate sign-ups.

Invites: every friend who joins the waitlist with your invite link moves you up the beta list. Only friends who confirm their email address count, and signing up yourself again with another address doesn't. Beta places are limited, so a place on the list doesn't guarantee one.

We may change or end the invite programme, but never in a way that takes away a founding code we have already sent you.

9. The beta

The beta is a test version of FemNote, available through Apple's TestFlight from February 2027. Apple's TestFlight terms also apply.

Beta versions can contain bugs, change or lose features, stop working when a test version expires, and lose data. Don't rely on the beta as the only record of anything important; use the export if you want a copy.

In the beta, purchases are test purchases: Apple doesn't charge you for them.

If you send us feedback or ideas, we may use them to improve FemNote without paying you or naming you. Please leave out health details.

10. Licence and your content

We give you a personal, non-exclusive, non-transferable licence to use the FemNote app on Apple devices you own or control, as these terms and the Usage Rules in Apple's Media Services Terms allow. This licence ends when the agreement between us ends.

The app, its design, texts, recipes, ingredient information, the name FemNote and the logo belong to us or our licensors. These terms only give you the right to use them as described here. Product data from Open Food Facts and Open Beauty Facts stays under its open licence, see Recognition, product information and recipes.

What you log and the photos you take stay yours, and we never claim them. When you send a photo or label text for recognition, you allow us and our providers to process it only to give you the result; it is not kept afterwards.

11. Using FemNote fairly

Please use FemNote for yourself and as intended. Don't:

  • use it to break the law or anyone's rights
  • send photos of people, documents or anything other than food, your fridge or labels for recognition
  • try to get around usage limits, Premium checks or security measures
  • copy, sell or rent out the app, or reverse engineer it, except where the law allows this
  • use bots or scripts to access our services, or overload or attack them
  • make fake or duplicate waitlist sign-ups, or misuse invite links or founding codes

12. Other companies' services

FemNote works with services from other companies: Apple (the App Store, your Apple ID, payments, Apple Health, Sign in with Apple, iCloud and TestFlight), Google (Sign in with Google), and Open Food Facts and Open Beauty Facts. Their own terms apply when you use them. When you use FemNote, you also have to follow other terms that apply to you, such as those of your mobile data plan.

We are not responsible for how those services work, but we are responsible for how FemNote uses them.

13. Availability and changes to FemNote

We work hard to keep FemNote available and working well, but it may sometimes be unavailable, for example during maintenance. Recognition, barcode lookups, sign-in and purchases need an internet connection.

We keep improving FemNote with updates, and you may need to install an update to keep using it. You have the rights the law gives you for digital content and services, including updates that keep FemNote working as described.

If we change Premium in a way that is clearly worse for you, we tell you at least 30 days in advance, and you can end your subscription before the change.

If we ever stop offering FemNote, we tell you at least 30 days in advance, make sure your subscription no longer renews, and give you time to export your data.

14. Our responsibility

We make FemNote with reasonable care and skill. We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or not using reasonable care. Loss is foreseeable if it was obvious it would happen, or if both of us knew it might happen when you started using FemNote.

We are not responsible for loss caused by events outside our reasonable control, or by your phone being lost, reset or replaced without a backup or export, because we have no copy of your log. FemNote is for personal use, so we are not responsible for business losses.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence, or for anything else the law doesn't allow us to limit. Nothing in these terms limits the rights you have as a consumer under the law of the country you live in.

15. Ending the agreement

You can stop using FemNote at any time. To end everything, use Delete my account and data in the app, and cancel your subscription in your Apple subscriptions.

We may suspend or end your access to our services, such as recognition or your account, if you seriously or repeatedly break these terms, commit fraud or misuse FemNote, or if the law requires it. Where we can, we warn you first and give you a chance to explain or put it right. The data on your phone stays yours.

Parts of these terms that by their nature apply after the agreement ends, such as our responsibility and disputes, keep applying.

16. Complaints and disputes

Not happy? Please tell us first, through the support page or at andreas.chitos@neurova-ai.com. A real person replies within 2 working days, and we try to solve it with you.

Dutch law applies to these terms. If you live in another country, you also keep the protection of the mandatory consumer law of the country you live in.

If we can't solve a dispute together, you can take it to the courts where you live or to a Dutch court. If we start a case against you, we will do so only in the courts where you live.

If you live in the EU, the European Consumer Centre in your country can help you for free with a complaint about a company in another EU country.

17. The App Store and Apple

Apple requires these points for apps from the App Store:

  • This agreement is between you and us, not Apple. We, not Apple, are solely responsible for the FemNote app and its content. These terms can't set usage rules that conflict with the Apple Media Services Terms and Conditions.
  • Your licence lets you use FemNote on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with you through Family Sharing or volume purchasing may also use it.
  • We, not Apple, are solely responsible for maintenance and support of the app, as described in these terms or as required by law. Apple has no obligation at all to provide maintenance and support for the app.
  • We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the app fails to conform to an applicable warranty, you can notify Apple, and Apple will refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility.
  • We, not Apple, are responsible for addressing any claims from you or others relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws, including in connection with its use of Apple Health (HealthKit).
  • If anyone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you are not located in a country that is subject to a US Government embargo or that the US Government has designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties.
  • Questions, complaints or claims about the app go to us: Neurova AI, Heideveldstraat 6, Eindhoven, the Netherlands, andreas.chitos@neurova-ai.com, or the contact form. Our other contact details are in the imprint.
  • When you use the app, you must comply with applicable third-party terms, such as your mobile data plan.
  • Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

18. Changes to these terms

We may update these terms, for example when FemNote or the law changes. We tell you about important changes in the app before they take effect, and at least 30 days in advance if they affect your subscription. If you don't agree, you can stop using FemNote and cancel your subscription before the change applies. The date at the top shows the current version.

19. Contact and other details

Questions? Use the support page or email andreas.chitos@neurova-ai.com. Our company details are in the imprint.

If part of these terms is invalid, the rest still applies. If we don't enforce a right straight away, we can still do so later.

We may transfer this agreement to a company that takes over FemNote. We will tell you first, it won't reduce your rights, and if you don't want to continue with that company, you can end the agreement. You may not transfer your rights under these terms to someone else.

These terms are in English and Dutch. If the two versions differ, the one that is more favourable to you applies.
